Magdeburg Ticket - General Terms and Conditions

General Terms and Conditions, effective from 19th September 2007

The sale of entrance tickets for events is exclusively regulated by the following General Terms and Conditions. These terms also apply to the sale of other items, if these are also on sale at the Magdeburg-Ticket advance sales office.

1. Once an entrance ticket has been purchased, a contractual relationship is established solely between the holder of the ticket (customer) and the organiser of the event in question.

2. Magdeburg-Ticket acts as the advance sales agency and provides its services with regard to the event in the name of and on behalf of the organiser; and it is authorised by the customer to handle the ticket purchase and/or dispatch tickets. Tickets are solely sold to final customers. A booking fee is charged for these services, which usually amounts to 10 % of the ticket price plus VAT. An extra service charge is payable if entrance tickets are posted. Magdeburg-Ticket is not responsible for ensuring that the tickets are delivered properly by the German postal service (Deutsche Post). If customers so wish, entrance tickets can be sent as registered post; but customers must pay for this extra service.

3. As soon as a customer has placed an order for a ticket, this constitutes a bid for a contract to be concluded.
The costumer has no right of withdrawal, when the tickets were purchased by telefon or internet.

4. Once the entrance ticket has been sold or sent out, the entrance ticket/event contract with the relevant organiser comes into effect as a result of the agency work performed by Magdeburg-Ticket.

5. The customer is responsible for obtaining any information about changes to the event (e.g. cancellation, change of venue, change of starting time).
If the event does not take place or not on the prescribed date or not in the envisaged manner – for whatever reason – the customer is not entitled to reclaim the entrance fee from the Magdeburg-Ticket advance sales agency. The same applies to any advance sales and processing fees.
However, Magdeburg-Ticket will seek to reach an appropriate agreement with the organiser on the refund of entrance tickets.
In principle Magdeburg-Ticket is not obliged to take back tickets if the organiser files for bankruptcy.

6. If Magdeburg-Ticket takes back entrance tickets in individual cases, this only applies to tickets, which have been purchased at its advance sales office. This arrangement does not entitle customers, who purchased tickets from other agencies, to demand a repurchase of their entrance tickets as a result.

7. The customer bears the risk of the organiser filing for bankruptcy.

8. The Magdeburg-Ticket advance sales agency does not provide any guarantee that the event will actually go ahead. It also cannot be held liable for any damage resulting from the event taking place or not, as the case may be.

9. No tickets will be exchanged!
